1. Acceptance & Eligibility #
By creating an account, accessing, or using TGCPilot ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into this agreement on behalf of a company or entity, you represent that you have the authority to bind such entity to these Terms.
2. Workspace Registration & Team Responsibilities #
You are responsible for maintaining the confidentiality of your workspace credentials, managing team permissions appropriately, and ensuring all activity within your workspace complies with applicable laws. Platform staff and workspace owners are responsible for revoking access for departing team members.
3. WhatsApp API & Acceptable Use Policy #
Your use of WhatsApp messaging through TGCPilot must strictly comply with Meta WhatsApp Business Policy. You agree NOT to: (a) send unsolicited bulk communications (spam) without explicit user opt-in consent; (b) distribute fraudulent, deceptive, or illegal content; (c) bypass Meta messaging rate limits or policies; or (d) misuse automated flow execution to harass end users. Violation may result in immediate suspension of WhatsApp connection privileges.
4. Subscriptions, Fees & Payment Terms #
Access to TGCPilot features is provided on a subscription basis. Fees are billed in advance according to your selected plan. All fees are non-refundable unless required by mandatory consumer laws. You are responsible for any applicable taxes and fees incurred by your payment method.
5. Intellectual Property Rights #
TGCPilot and its original software, branding, UI components, and documentation remain the exclusive property of TGCPilot. You retain full ownership of all business content, contact lists, templates, and message data uploaded to your workspace.
6. Service Level & Availability #
We strive to maintain high service availability (target 99.9% uptime). However, TGCPilot depends on third-party cloud infrastructure and Meta WhatsApp Cloud API availability. We are not liable for service interruptions caused by Meta API outages, internet disruptions, or scheduled maintenance announced in advance.
7. Limitation of Liability #
To the maximum extent permitted by law, TGCPilot shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or loss of profits, data, or business opportunities arising out of or related to your use of the Service.
8. Termination & Workspace Cancellation #
You may cancel your workspace subscription at any time through workspace settings. We reserve the right to suspend or terminate accounts that breach these Terms, engage in fraudulent activity, or violate Meta WhatsApp acceptable use policies.
9. Governing Law & Dispute Resolution #
These Terms shall be governed by and construed in accordance with applicable governing laws. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of competent courts.
10. Changes to Terms #
We reserve the right to modify these Terms at any time. Notice of material updates will be provided via email or in-app workspace notification prior to the effective date of changes. Continued use of the Service following effective changes constitutes acceptance.
